Protecting personal data and your privacy is of greatest concern for the Whitepage Inc. In this Privacy Notice we want to give a clear, concise, and transparent communication on the collection, use, processing, storing etc. of personal data relating to customers of the Whitepage Inc.

Within the meaning of this Privacy Notice “customer of Whitepage Inc” means former, current and potential customer or user of a product or service offered by a Whitepage Inc  affiliate or brand, visitors to one of our official websites or stores, member of a loyalty program or community, enrolled to newsletter.

The Whitepage Inc manifests its commitment to privacy and data protection by embracing the following principles.

Whitepage Inc uses personal data lawfully, fairly, correctly and in a transparent manner.
Whitepage Inc collects no more personal data than necessary, and only for a legitimate purpose.

Why do we process your data?
We use and process your personal data in connection with you for example, buying our products online or in-store, visiting our website or contacting customer service. Examples of personal data are full name, address, e-mail address, telephone number, social security number, payment information, purchase, order and usage history, IP address, member id and other case-related information (eg information that you provide when contacting our customer service).

Who is responsible for processing of your personal data?
Whitepage Inc is primary responsible for the processing of personal data within the scope of this Privacy Notice.

Under certain circumstances the responsibility for data protection and your privacy is shared with third parties, such as banking and financial institutes, postal services or electronic communication providers. More information can be found under each specific section of this Privacy Notice.

Where do we process your data?
The personal data that we collected from you is generally stored within a country of the European Union or the European Economic Area (“EU/EEA”) but may also, whenever necessary, be transferred to and processed in a country outside of the EU/EEA. Any such transfer of your personal data will be carried out in compliance with applicable laws and without undermining your statutory rights.

From time to time we may transfers personal data from the EU/EEA to a third country not being approved by European commission as a safe country for such transfer (adequacy decision). Whenever applicable Whitepage Inc will ensure an equivalent level of protection as granted within the EU/EEA or other lawful grounds for transfer. 

Who has access to your data?
Your personal data is available and accessible only by those who need the data to accomplish the intended processing purpose. To the extent necessary, your personal data may be shared between the companies and brands within the Whitepage Inc, with suppliers, sub-contractors and independant third-parties (acting as processors and sub-processors) carrying out certain tasks on Whitepage Inc’s behalf.

What is the legal ground for processing?
Whitepage Inc is not allowed to collect, process, use, store etc. personal data without a valid legal ground. Lawfulness may be derived from your consent, by contract, statutory obligations or from our legitimate interest as a business. For each specific process purpose of processing of personal data, we will inform you about which legal ground that will apply, and what rights you are entitled to exercise, whether the provision of personal data is statutory or required to enter a contract and whether it is an obligation to provide the personal data and possible consequences if you choose not to.

What are your rights?

Right to access:
You have the right to request information about the personal data we hold on you at any time. You can contact Whitepage Inc and we will provide you with your personal data via e-mail.

Right to portability: 
Whenever Whitepage Inc processes your personal data, by automated means based on your consent or based on an agreement, you have the right to get a copy of your data transferred to you or to another party. This only includes the personal data you have submitted to us.

Right to rectification: 
You have the right to request rectification of your personal data if the data is incorrect, including the right to have incomplete personal data completed. 

If you have a Whitepage Inc account (Whitepage Inc membership), you can edit your personal data under your account pages.

Right to erasure:
You have the right to erase your personal data processed by Whitepage Inc at any time. Your request may be hindered if any of the following situation apply:

*you have an ongoing matter with Customer Service
*you have an open order which has not yet been shipped or partially shipped
*you have a balance with Whitepage Inc, regardless of the payment method

Right to object to processing based on legitimate interest: 
You have the right to object to processing of your personal data that is based on Whitepage Inc's legitimate interest. Whitepage Inc will not continue to process the personal data unless we can demostrate legitimate grounds for the process which overrides your interest and rights or due to legal claims.

Right to restriction:
You have the right to request that Whitepage Inc restricts the process of your personal data under the following circumstances:

* if you object to a processing based Whitepage Inc's legitimate interest, Whitepage Inc shall restrict all processing of such data pending the verification of the legitimate interest.
* if you have claim that your personal data is incorrect, Whitepage Inc must restrict all processing of such data pending the verification of the accuracy of the personal data.
* if the processing is unlawful you can oppose the erasure of personal data and instead request the restriction of the use of your personal data instead
* if Whitepage Inc no longer needs the personal data but it is required by you to defend legal claims.

How do you exercise your rights?
We take data protection very seriously. If you wish to exercise your rights as set out above or if you have any questions about our privacy policy or our processing of your data, you can contact us at any time at crew@whitepageinc.com.

If you have a Whitepage Inc Account you can exercise your right to access, portability and rectification under your account pages, where you also can delete your account.

Data Protection Officer:
We have appointed a Data Protection Officer to ensure that we continuously process your personal data in an open, accurate and legal manner. You can contact our Data Protection Officer crew@whitepageinc.com and write DPO as subject matter.

Right to complain with a supervisory authority: 
If you have complaints about the way Whitepage Inc processes and protects your personal data and privacy you have the right, at any time, to make a complaint to the Switzerland Authority for Privacy Protection or any other competent a supervisory authority in the country of residence.

We may need to update our Privacy Notice. The latest version of the Privacy Notice is always available on our website. 


 

TERMS & CONDITIONS

  1. General
    The following terms and conditions apply to all orders placed by the customer (hereinafter referred to as ”you”) with Whitepage Inc, (hereinafter referred to as “Whitepage Inc”, ”us ” or ”we”), at the Whitepage Inc website, mobile website, or mobile application, (jointly referred to as ”whitepageinc.com”).

By using whitepageinc.com and/or placing an order, you agree to be bound by the terms and conditions set out herein (the ”Terms”). Please make sure you have read and understood the Terms before placing your order.

Only natural persons 18 years or older, who are not under guardianship, and are not acting in a capacity of a company, with a delivery address in Switzerland (excluding mail forwarding companies) can place an order.

The inclusion of any products or services on whitepageinc.com at a particular time does not imply or warrant that these products or services will be available at any time. We reserve the right to discontinue any product at any time.

We reserve the right to amend these Terms from time to time without prior notice to you. The version of the Terms that will apply to your order will be those on whitepageinc.com at the time you place your order.

Whitepage Inc want to provide the best possible online experience. To make this possible we need to ensure that our services runs like a clockwork. You understand and agree not to (i) post, transmit, redistribute, upload, or promote any communications or content that could harm or negatively impact our business, products or services; (ii) act in a manner or employ any device that restricts, impairs, interferes or inhibits any other user from using or enjoying the whitepageinc.com site, or which impacts the security of the site, or (iii) employ any device or attempt to use any engine, software, tool, agent, script or other device or mechanism (including without limitation spiders, bots, crawlers, avatars or intelligent agents) to navigate or search the site, or to copy content from the site. We reserve the right to immediately bar access to the site and close the account of any user who violates this provision or any other provision in these terms and conditions.

  1. Prices and delivery charges
    The prices displayed at whitepageinc.com include the statutory Value Added Tax but do not include a delivery charge.

The delivery charge for each order is related to the size or weight of your order. If we are unable to deliver your order in full and have to make more than one delivery, there will not be an additional charge for any subsequent deliveries. Prices in store, catalogue and online may vary.

  1. Ordering/conclusion of contract
    The ordering option available to you is via whitepageinc.com.

Once you have placed your order, if you have supplied us with your email address, you will receive an email confirmation. If for any reason we are unable to fulfill your order, we will let you know at the earliest opportunity. If we have already received payment for such order, we will attempt to refund the applicable amount using the same method used to make the payment. If, for any reason, alternative arrangements are necessary, we will notify you and ask you to contact Whitepage Inc Customer Service who will settle the refund.

  1. Delivery
    Whitepage Inc exercises the utmost diligence in accepting and processing orders and will endeavour to deliver your order to a physical address in Switzerland, in accordance with your selected delivery option.

Whitepage Inc products are handcrafted, and we commit to dispatch orders in the fastest possible time and in the order in which they are placed once the products are ready. Though we aim to deliver within the communicated time frame, delivery may take longer due to unexpected events.

Before you place your order, you will be informed of the expected delivery details. Once you have placed your order, if you have supplied us with your email address, you will receive an email confirmation with your expected delivery details.

If your order does not arrive by the scheduled date, please contact Whitepage Inc Customer Service via email  crew@whitepageinc.com.

  1. Withdrawal of order
    You may cancel or return your order from the date you place the order until 30 days after receipt of the ordered items. If you have been charged for the items, you will receive a refund which will include Whitepage Inc's standard delivery costs and exclude the cost of the return of the items to Whitepage Inc, should such return cost have been generated. Should you choose to keep certain items and only partially cancel your order, the delivery cost will not be refunded.

If you wish to cancel or return your order, please provide us with notice in writing either by post or via email to crew@whitepageinc.com and return the item(s) to us as set out in section 6 (Returns) below within the 30 day period set forth in this section. We will provide a refund attempting to use the same method used to make the payment (or, if the items have not yet been paid for, reflect the return of the items in your account balance) as soon as possible and at the latest within 30 days of receiving the items, provided we have received the items or evidence of you having sent back the items. Another payment method may be used for the refund, provided that you consent to such change; in any case this will not generate any additional charges.

If the item you have received is defective, please notify Whitepage Inc promptly and return the item in accordance with section 6 (Returns) below. Whitepage Inc will, for any products deemed defective, provide a full refund. The provisions set forth herein do not limit any applicable statutory rights.

  1. Returns
    Whitepage Inc guarantees a full refund any returned items in accordance with section 5 (Withdrawal of Order), provided that all items are returned in the same condition they were in upon your receipt. This means the items should not have been damaged, soiled, washed, altered or worn (other than to try the item on) and that any labels or tags should be intact.

You will be refunded by the same payment method you used to make your purchase, in accordance with section 5 above.

  1. Payment methods
    You can pay for your goods in various ways as set out below.

Payment before delivery
Credit card or debit card
You can enter your payment details at the time you place your order using a valid credit or debit card. The applicable amount will immediately be reserved on your card but will not be debited until the goods are dispatched. Whitepage Inc reserves the right to check the validity of the credit or debit card, its credit status in relation to the order value and whether the address data of the purchaser is correct. We may refuse orders depending on the result of these checks.

PayPal
When paying by PayPal, Whitepage Inc reserves the right to check the validity of the PayPal account, that there are enough funds to cover the purchase sum and validate the billing address details of the purchaser. The applicable amount will immediately be reserved on your PayPal account but will not be debited until the goods are dispatched from the warehouse. Whitepage Inc reserves the right to deny any purchase.

Whitepage Inc gift cards
You can choose to pay the whole or part of your order placed on our website with Whitepage Inc gift cards and Whitepage Inc merchandise cards.

Others
You will receive the legally required invoice document in the Shipping Confirmation e-mail. 

  1. Our Liability
    Nothing in these Terms shall exclude or limit Whitepage Inc's liability with regard to any matter for which it would be unlawful for us to limit or exclude our liability.

Whitepage Inc is not responsible for indirect losses which are a side effect of the main loss or damage, for example loss of profits or loss of opportunity; or for failure to deliver the goods or to meet any of our other obligations under these Terms where such failure is due to an event that is beyond our reasonable control, which includes but is not limited to fire, flood, storm, riot, civil disturbance, war, nuclear accident and terrorist activity.

Our maximum liability to you for any loss or damage arising in connection with your order on whitepageinc.com shall be limited to the total price of your order.

  1. Colours and measurements
    We make all reasonable efforts to accurately display the attributes of our products, including composition and colours. The colour you see will depend on your computer system, and we cannot guarantee that your computer will accurately display such colours.

An item’s measurements given on whitepageinc.com are only approximate values to give you a better understanding of the model or fit of that specific item, and not a definite guarantee of the actual measurements of the item you receive. The final measurements of an item may vary depending on the material used in its production.

  1. Guarantee
    If there are defects in the goods you have purchased, Whitepage Inc abides by all statutory guarantee regulations. If you have a complaint regarding obvious material or manufacturing faults in goods that we have supplied, including damage incurred in transit, please let us know by returning the goods to us without delay by using the provided pre-printed return form.
  2. Assignment
    Whitepage Inc reserves the right to assign or pledge to third parties any claim(s) for payment [including any payment instalments] which have arisen in connection with the delivery of goods.
  3. Severance
    If any part of these Terms is disallowed or found to be ineffective by any court or regulator, the other Terms shall continue to apply.
  4. Ownership of rights
    All intellectual property rights, such as trademarks and copyrights at whitepageinc.com remain with Whitepage Inc and its subsidiaries or licensors. Any use of whitepageinc.com or its contents, including copying or storing such content in whole or part, other than for your own personal, non-commercial use, is prohibited without the permission of Whitepage Inc.
